Meghalaya High Court Flags Discrepancies in Mineral Transport Report, Seeks Detailed Affidavits

Shillong, April 29: The Meghalaya High Court has expressed concern over inconsistencies in a state transport report on mineral movement, observing that the figures presented may have been misleading and directing authorities to submit detailed affidavits.

The observations came during the hearing of PIL No. 4 of 2026, where a status report filed by the state was placed on record. The report claimed that between April 2025 and February 2026, a total of 2,030 vehicles transported 25,902 metric tonnes of minor minerals, averaging fewer than seven vehicles per day through the Jaintia Hills Territorial Division.

However, the bench noted that this assertion appeared to conflict with a chart annexed to the same report. When questioned, the Advocate General sought additional time to obtain instructions. The court remarked that the statement was “completely contrary” to the annexed data, indicating a possible attempt to mislead the court regarding the actual figures.

The order also drew attention to gaps in enforcement. While some violations under the Motor Vehicles Act were recorded and penalties imposed, there was no evidence of prosecution between April 22 and April 25, 2026. The court further pointed out the absence of data indicating whether the offenders were first-time or repeat violators.

Authorities have been asked to clarify whether a centralised database exists to track registered vehicles, penalties and repeat offences. The court has directed relevant departments to file affidavits by May 4.

A separate report from border authorities stated that their primary responsibility is to provide security and that they are not authorised to verify documents such as driving licences, pollution certificates or vehicle fitness records.

To assist the proceedings, Philemon Nongbri has been appointed as amicus curiae. The court has also directed the Commissioner of Transport and the Secretary of the Forest Department to be present at the next hearing, which is scheduled for May 6.
