Assam to Seek Fast-Track Court for Zubeen Garg Death Case After Chargesheet Filing

The Assam government will move the Gauhati High Court to set up a fast-track court to hear the Zubeen Garg death case, Chief Minister Himanta Biswa Sarma said on December 12, shortly after investigators filed an extensive chargesheet against several accused.

Speaking to reporters, Sarma said the state would formally request the Chief Justice of the Gauhati High Court to constitute a fast-track court once the case is committed to the sessions court. He also confirmed that the government plans to appoint a special public prosecutor to handle the matter, describing these as the next procedural steps to be followed with care.

The chargesheet has been submitted before the Court of the Chief Judicial Magistrate and runs to around 12,000 pages. It includes murder charges under Section 103 of the Bharatiya Nyaya Sanhita against multiple accused, while one individual has been booked for culpable homicide. Two personal security officers linked to the case have been charged separately.

Highlighting the scope of the investigation, the chief minister said evidence had been gathered both domestically and from Singapore, where the incident occurred. However, he stressed that the prosecution’s case does not depend solely on foreign material. According to Sarma, the chargesheet has been structured in a manner that allows the case to stand even if documents obtained from Singapore are ruled inadmissible, as sufficient evidence has been collected within Assam.

Reiterating his faith in the judicial system, Sarma said the government respects the independence and impartiality of the courts and is confident that due process will ensure justice for the victim. He added that the state’s role now is limited to facilitating the legal framework, with the matter set to move forward through court proceedings.

Once the case is formally transferred to the sessions court, the Assam government will proceed with its applications for a fast-track court and the appointment of a special public prosecutor.
